Privacy Policy
With this Privacy Policy, we inform you about what personal data we process, how, for what purpose and where, particularly in connection with our www.educationarchitects.org website (hereinafter eduARC) and our other services. With this Privacy Policy, we also inform you about the rights of individuals whose data we process.
For individual or additional offers and services, special, supplementary or additional privacy policies as well as other legal documents such as General Terms and Conditions (GTC), Terms of Use, or Terms of Participation may apply.
1. Contact Addresses
Responsibility for the processing of personal data:
Georg Gusewski
4058 Basel
We will indicate if there are other parties responsible for processing personal data in individual cases.
2. Processing of Personal Data
2.1 Terms
Personal data refers to all information relating to an identified or identifiable person. A data subject is a person about whom personal data is processed. Processing includes any handling of personal data, regardless of the means and procedures used, particularly the storage, disclosure, collection, gathering, deletion, saving, modification, destruction, and use of personal data.
2.2 Legal Basis
We process personal data in accordance with Swiss data protection law, particularly the Federal Act on Data Protection (FADP) and the Ordinance to the Federal Act on Data Protection (DPO).
2.3 Nature, Scope and Purpose
We process the personal data that is necessary to provide our services in a permanent, user-friendly, secure, and reliable manner. Such personal data may fall into the categories of inventory and contact data, browser and device data, content data, meta or peripheral data and usage data, location data, sales, contract, and payment data.
We process personal data for the duration required for the respective purpose or purposes, or as legally required. Personal data that is no longer necessary for processing will be anonymized or deleted. Persons whose data we process have in principle a right to deletion.
We process personal data in principle only with the consent of the data subject, unless processing is permissible for other legal reasons, such as to fulfill a contract with the data subject and for corresponding pre-contractual measures, to protect our overriding legitimate interests, because the processing is apparent from the circumstances, or after prior information.
Within this framework, we particularly process information that a data subject voluntarily and independently transmits to us when making contact - for example by postal mail, email, contact form, social media, or telephone - or when registering for a user account. We may store such information, for example, in an address book or with comparable tools. If you transmit personal data about third parties to us, you are obligated to ensure data protection for such third parties and guarantee the accuracy of such personal data.
We also process personal data that we receive from third parties, obtain from publicly accessible sources, or collect while providing our services, if and to the extent such processing is legally permissible.
2.4 Processing of Personal Data by Third Parties, Including Abroad
We may have personal data processed by commissioned third parties or process it jointly with third parties as well as with the help of third parties or transfer it to third parties. Such third parties are particularly providers whose services we use. We ensure appropriate data protection with such third parties as well.
Such third parties are generally located in Switzerland and the European Economic Area (EEA). However, such third parties may also be located in other countries and territories on Earth as well as elsewhere in the universe, provided their data protection law ensures adequate data protection according to the assessment of the Federal Data Protection and Information Commissioner (FDPIC), or if adequate data protection is ensured for other reasons, such as through appropriate contractual agreements, particularly on the basis of standard contractual clauses, or through appropriate certification. In exceptional cases, such a third party may be located in a country without adequate data protection, provided that the data protection requirements, such as the explicit consent of the data subject, are met.
3. Rights of Data Subjects
Data subjects whose personal data we process have rights in accordance with Swiss data protection law. These include the right to information as well as the right to rectification, deletion, or blocking of the processed personal data.
Data subjects whose personal data we process have the right to lodge a complaint with a competent supervisory authority. The supervisory authority for data protection in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC).
4. Data Security
We implement appropriate and suitable technical and organizational measures to ensure data protection and particularly data security. However, despite such measures, the processing of personal data on the internet can always have security vulnerabilities. We therefore cannot guarantee absolute data security.
Access to our online services occurs via transport encryption (SSL / TLS, particularly with Hypertext Transfer Protocol Secure, abbreviated as HTTPS). Most browsers indicate transport encryption with a padlock symbol in the address bar.
Access to our online services is subject to – as is fundamentally true for all internet usage – indiscriminate and suspicionless mass surveillance as well as other monitoring by security authorities in Switzerland, the European Union (EU), the United States of America (USA), and other countries. We cannot directly influence the corresponding processing of personal data by intelligence services, police agencies, and other security authorities.
5. Website Usage
5.1 Cookies
We may use cookies for our website. Cookies - both our own cookies (first-party cookies) and cookies from third parties whose services we use (third-party cookies) - are data that are stored in your browser. Such stored data is not limited to traditional text-form cookies. Cookies cannot execute programs or transfer malware such as trojans and viruses.
Cookies can be stored in your browser temporarily as "session cookies" or for a specific period as permanent cookies when you visit our website. "Session cookies" are automatically deleted when you close your browser. Permanent cookies have a specific storage duration. They enable, in particular, recognition of your browser when you next visit our website and thus allow us to measure the reach of our website. However, permanent cookies can also be used for online marketing, for example.
You can disable and delete cookies in your browser settings completely or partially at any time. Without cookies, our website may no longer be fully available. We request - if and to the extent necessary - your explicit consent for the use of cookies.
For cookies used for success and reach measurement or for advertising, a general objection ("opt-out") is possible for numerous services via the Network Advertising Initiative (NAI), YourAdChoices (Digital Advertising Alliance) or Your Online Choices (European Interactive Digital Advertising Alliance, EDAA).
5.2 Server Log Files
For each access to our website, we may collect the following information, if transmitted by your browser to our server infrastructure or if it can be determined by our web server: date and time including time zone, Internet Protocol (IP) address, access status (HTTP status code), operating system including user interface and version, browser including language and version, accessed individual sub-pages of our website including transferred data volume, last webpage accessed in the same browser window (referrer).
We store such information, which may also constitute personal data, in server log files. The information is necessary to provide our online service permanently, user-friendly and reliably, as well as to ensure data security and thus particularly the protection of personal data - including through third parties or with the help of third parties.
5.3 Counting Pixels
We may use counting pixels on our website. Counting pixels are also known as web beacons. Counting pixels - including those from third parties whose services we use - are small, usually invisible images that are automatically retrieved when visiting our website. The same information as in server log files can be collected with counting pixels.
6. Social Media
We maintain a presence on social media platforms and other online platforms to communicate with interested persons and inform them about our services. Personal data may also be processed outside of Switzerland and the European Economic Area (EEA).
The General Terms and Conditions (GTC), terms of use, privacy policies, and other provisions of the individual operators of such online platforms also apply. These provisions particularly inform about the rights of affected persons, including the right to information.
7. Success and Reach Measurement
Google Analytics
We use Google Analytics to analyze how our website is used, whereby we can also measure the reach of our website and the success of third-party links to our website. This is a service of the American Google LLC. For users in the European Economic Area (EEA) and Switzerland, the Irish Google Ireland Limited is responsible.
Google attempts to track individual visitors to our website even when they use different browsers or devices (Cross-Device Tracking). Cookies are also used for this purpose. Your Internet Protocol (IP) address is required for Google Analytics but is not combined with other data from Google.
In any case, we have your Internet Protocol (IP) address anonymized before analysis by Google. As a result, your complete IP address is generally not transferred to Google in the USA.
Further information about the nature, scope, and purpose of data processing can be found in Google's Privacy and Security Principles and Privacy Policy, in the Google Products Privacy Guide (including Google Analytics), in the information about how Google uses data from sites where Google services are used, and in the information about cookies at Google. There is also the option to use the "Browser Add-on to Deactivate Google Analytics" and to object to personalized advertising.
8. Third-Party Services
We use third-party services to provide our offering permanently, user-friendly, secure, and reliable. Such services also serve to embed content in our website. Such services - for example hosting and storage services, video services, and payment services - require your Internet Protocol (IP) address, as these services cannot otherwise transmit the corresponding content. Such services may be located outside of Switzerland and the European Economic Area (EEA), provided adequate data protection is guaranteed.
For their own security-relevant, statistical, and technical purposes, third parties whose services we use may also process data in connection with our offering and from other sources - including with cookies, log files, and counting pixels - in an aggregated, anonymized, or pseudonymized manner.
8.1 Digital Infrastructure
We use third-party services to utilize the required digital infrastructure for our offering. This includes, in particular, hosting and storage services from specialized providers. Such providers process - usually exclusively on our behalf - the data necessary for the operation of this infrastructure. This includes, in particular, your Internet Protocol (IP) address. We ensure adequate data protection with such providers as well.
Magic Pages (Magicpages.co) provides hosting services ("the Services"), which include web hosting, server space, technical support, and other infrastructure services that eduARC needs to host one or more instances of the Ghost CMS Software on Magic Pages' servers. Information about Privacy Policy, General Terms and Conditions, and Legal Notice.
8.2 Audio and Video Conferences
We use services for audio and video conferences to communicate with our customers and other persons. With these, we can particularly conduct audio and video conferences, virtual meetings, and training sessions such as webinars.
We only use services where adequate data protection is guaranteed. Any conditions of the services used, such as terms of use or privacy policies, apply in addition to this privacy policy.
We particularly use Zoom, a service of the American Zoom Video Communications Inc. Zoom grants the rights under the European General Data Protection Regulation (GDPR) also to users in Switzerland. Further information about the nature, scope, and purpose of data processing can be found in Zoom's Privacy Policy and on the Legal and Privacy page.
8.3 Maps
We use Google Maps to embed maps in our website. Cookies are also used for this purpose. Google Maps is a service of the American Google LLC. For users in the European Economic Area (EEA) and Switzerland, the Irish Google Ireland Limited is responsible. Further information about the nature, scope, and purpose of data processing can be found in Google's Privacy and Security Principles and Privacy Policy, in the Google Products Privacy Guide (including Google Maps), in the information about how Google uses data from sites where Google services are used, and in the information about cookies at Google. There is also the option to object to personalized advertising.
8.4 Fonts
We use Google Fonts to embed selected fonts in our website. No cookies are used for this purpose. This is a service of the American Google LLC that is offered independently of other Google services. For users in the European Economic Area (EEA) and Switzerland, the Irish Google Ireland Limited is responsible. Further information about the nature, scope, and purpose of data processing can be found in Google's Privacy and Security Principles and Privacy Policy.
9. Final Provisions
We created this privacy policy with the Privacy Policy Generator from Datenschutzpartner.
We may adapt and supplement this privacy policy at any time. We will inform about such adaptations and supplements in an appropriate manner, particularly by publishing the current privacy policy on our website.
